On 14 June 2021, the Judicial Committee of the Privy Council issued a decision in Betamax Ltd v State Trading Corporation [2021] UKPC 14 on the scope of application of the public policy ground for setting aside an arbitral award pursuant to the Mauritian International Arbitration Act.

The decision is instructive of the approach courts in England & Wales are likely to adopt in dealing with applications to set-aside awards based on allegations of illegality by reason of bribery, corruption or otherwise.
